Five Star Professional Transportation Service, LLC, hereinafter referred to as “the Operator,” confirms that the yacht is insured against fire, accident, and various risks, and maintains liability insurance. However, the Charterer (referred to as “you”) agrees to indemnify and hold harmless the Operator from any liabilities, losses, or damages incurred by the Charterer, their party members, or any third parties and their property due to the Charterer’s negligence or intentional actions. It is explicitly stated that the Operator shall bear no liability towards the Charterer or their party members under any circumstances, even if such circumstances involve the negligence of the Operator, including cases resulting in death.
Throughout the duration of the Charterer’s use of the yacht, the Operator and/or its representatives will be present onboard.
The Charterer acknowledges and consents to the strict prohibition of the use, transportation, or possession of drugs, narcotics, contraband, or participation in any unlawful activities. Firearms are strictly prohibited onboard the yacht at all times. Any violation of this provision by the Charterer or their party members will constitute a breach of this Agreement, leading to immediate termination without refund, and the Charterer will be held liable for any loss or damage to the yacht resulting from such violations.
The Charterer agrees to assume responsibility for any damages or losses to the yacht, furnishings, or equipment caused by their negligence or intentional actions, as well as those of their party members.
The Charterer affirms that the yacht will be utilized exclusively for recreational purposes and shall not be engaged in the transportation of goods or any commercial activities that contravene the laws of the United States or any other relevant jurisdiction.
Refund Policy:
In the event of a cancellation made at least 7 days prior to the scheduled date, a full (100%) refund will be issued. Cancellations within 6 days of the scheduled departure eligible for a refund minus $350 administration fee. No refunds or credits will be issued for cancellations made within 48 hours of the reservation or in the case of no-shows, regardless of weather conditions. However, cancellations initiated by the Operator, excluding weather-related reasons, are eligible for a full refund.
No refunds will be issued due to weather conditions or circumstances beyond the Operator’s control, such as acts of war, terrorism, pandemics, or governmental regulations. Nevertheless, the Charterer is permitted to reschedule for a later date if adverse lake weather conditions pose safety concerns for the voyage.
